GSTR-10: A Comprehensive Guide to Final Return Submission

The GSTR-10 return is a return form under the Goods and Services Tax (GST) system in India. It is specifically for taxpayers who have registered for GST but have subsequently canceled their registration. GSTR-10 is also known as the Final Return. It includes details of stock held on the last day of the registration period, along with liabilities and input tax credit (ITC) availed. Within three months of the cancellation date or the cancellation order date, whichever comes first, this return must be filed.

Every taxpayer needs to fill out Form GSTR-10 except the following -
  • Input Service Distributor
  • Non-resident taxable persons
  • Persons required to deduct tax at source (TDS) under Section 51
  • Persons paying tax under Section 10 (Composition Taxpayer)
  • Persons required to collect tax at source (TCS) under Section 52
The following are the pre-conditions for filing Form GSTR-10 –
  • Taxpayers should have a valid user ID and password.
  • The taxpayer should have requested the cancellation of their registration, and an order for that purpose has been issued; alternatively, if the tax authorities canceled the registration on their own, an order for that purpose has been issued.
The process to file Form GSTR-10, which taxpayers need to follow:

It can be accessed on the GST Portal after taxpayers log in. They need to use the following: Services > Returns > Final Return. Returns in Form GSTR-10 can be filed offline as well. To fill it out offline, the taxpayer needs to follow the following process:

  • Download the GSTR-10 Offline Utility-Visit the GST portal and navigate to the Downloads section. Under the "Offline Tools" section, download the GSTR-10 offline utility.
  • Extract the Utility - Once downloaded, extract the utility from the system. It will be in a.zip file format.
  • Open the Utility - Open the extracted folder and run the utility file named "GSTR_10_Offline_Utility.exe.".
  • Fill in the Details taxpayer details, period, table-wise details, and verification.
  • Validate and Generate JSON File - Once all the details are filled in, validate the data using the 'Validate' button provided in the utility. Correct any errors if found. After successful validation, generate the JSON file by clicking on the 'Generate JSON File to Upload' button.
  • Upload JSON to the GST Portal-Go to the GST portal and log in using your credentials. Navigate to 'Services' > 'Returns' > 'Returns Dashboard.' Click on the 'Prepare Offline' button under 'GSTR-10'. Upload the JSON file generated from the offline utility.
  • Preview and Submit - After uploading the JSON file, preview the details filled out in the GSTR-10 form on the portal. Verify all the details once again. If everything is correct, proceed to submit the form.
  • File using DSC or EVC-After submitting, the taxpayers can file the form using a Digital Signature Certificate (DSC) or Electronic Verification Code (EVC), as per their preference.
  • Acknowledgment-Once the form is successfully filed, an acknowledgment receipt will be generated. Download and save it for records.
  • Payment of Tax Liability - If there's any tax liability declared in GSTR-10, make the payment through the online portal using the appropriate challan.
The following are the format rules for GSTR-10-
  • Legal Requirements - Ensure that the form adheres to the legal requirements set forth by the GST laws and regulations in force at the time of filing.
  • Correct Details - Provide accurate details about the taxpayer and the period for which the return is being filed.
  • Input Tax Credit (ITC) - Provide details of any remaining ITC that needs to be paid back to the government.
  • Liability Declaration - Declare the tax liabilities, including taxes payable on the supply of goods or services, taxes on outward supplies, interest, late fees, and any other liabilities.
  • Payment of Liabilities - Ensure that the taxpayer has paid all liabilities, including tax, interest, late fees, and any other amounts due.
  • Nil Return Filing - If there are no liabilities to declare, ensure that a nil return is filed, indicating that there are no outstanding liabilities.
  • Verification - The authorized signatory should duly verify the form.
  • Digital Signature - If filing electronically, the form should be digitally signed by the authorized signatory.
  • Documentary Proof- Attach any required documentary proof to support the details provided in the return.
  • Accuracy - Double-check all the entries and calculations to ensure accuracy and compliance with GST laws.
  • Timeliness - File the return within the prescribed due date to avoid penalties or late fees.
  • Amendment - In the event of any errors or omissions, amendments should be made promptly and accurately.
GSTR 10 late fee details and amount to be paid –

The taxpayers will be charged Rs. 100 CGST and Rs. 100 SGST per day. So, a total of Rs 200 per day is to be paid until the date of actual payment. There is no maximum penalty limit for GSTR-10 filing.
